⚠️ ClutchUp is currently in beta. By creating an account or using this platform, you acknowledge that it is under active development, may contain bugs, and is provided without any guarantees. Please read these terms before proceeding.

1. Beta Status

ClutchUp is an early-stage product. Features may change, break, or be removed without notice. Data loss, downtime, and bugs are possible. Use at your own discretion.

2. What ClutchUp Does & Does Not Do

ClutchUp helps users find public playgrounds and courts, form teams, and organize games with other users. We do not own, operate, inspect, or maintain any court, field, or facility listed on the platform. We do not verify the identity, background, skill level, or intentions of any user you may meet or play against through the app.

3. Assumption of Risk — Physical Activity

Sports and physical activity carry inherent risk of injury, including serious injury. By using ClutchUp to organize, join, or attend any game, match, or meetup, you voluntarily assume all risks associated with that activity, including risks arising from the condition of the playing surface or facility, the conduct of other players, and travel to or from the location. You are solely responsible for assessing your own fitness to participate and for meeting other users in a manner you are comfortable with. ClutchUp is not present at, and has no control over, any game organized through the platform.

4. No Warranty

ClutchUp is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to accuracy of court locations, availability of facilities, or the conduct of other users.

5. Limitation of Liability

To the maximum extent permitted by law, ClutchUp and its operators are not liable for any injury, loss, damage, or dispute arising from your use of the platform, including but not limited to injuries sustained during games, disputes with other users, or reliance on information provided through the app.

6. User Conduct

You agree to treat other users respectfully, to show up to games you commit to, and not to use the platform for harassment, fraud, or any unlawful purpose. We reserve the right to suspend or terminate accounts that violate this.

8. Age Requirement

You must be at least 13 years old to create an account. Users under 18 should have a parent or guardian's awareness before organizing in-person meetups through the platform.

9. Governing Law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
